In 2014, there were 7,666 alcohol-related crashes reported by DMV. Of these, 237 involved fatalities and another 3413 involved reported injuries. These numbers are the lowest in the past five years, but still too high.

If you have a cell phone, take photos of the scene. If you're not able to do so, see if a friend or family member can help. Photos are very helpful in proving your case.

This is a common source of frustration! Insurance companies must investigate the accident and contact their insured before they will agree to pay for anything. Sometimes this can take days -- all while you are without a car! -

The best way around this is to get a rental under your own policy, if it is covered or pay out-of-pocket for a rental and get reimbursed once liability is accepted!

Food for Thought: Uninsured Motorists' Fee - you may pay DMV $500 for the privilege of driving in Virginia without a policy of liability insurance. Payment of this fee does NOT provide the motorist with any insurance.
To protect yourself in the event that you are hurt by an uninsured motorist, be sure to check the UM/UIM coverage under your auto policy. -

FAQ: The insurance company won't pay enough to pay off my car loan! What can I do? In Virginia, the victim is entitled to either the cost of repairing the vehicle, or the fair market value of the car if it is a total loss. Fair market value in Virginia is defined by the NADA retail value. If the insurance company offer is in the neighborhood of that value, it is probably accurate. This is an area where the law is not favorable to consumers who suffer property damage in an auto accident as Virginia does NOT require payment of "replacement value."

I have heard about accredited institutions offering a new type of law degrees called Masters of Arts in Law where the recipient is not permitted to take the bar exam but can perform most of the other functions of a lawyer. If you've been injured by a drunk driver, you may be able to obtain punitive damages in Virginia. In the early 1990s, victims' advocacy groups like MADD and SADD joined with the Virginia General Assembly to write laws that would allow drunk driving victims the opportunity to sue for punitive damages.

To obtain punitive damages in Virginia, you must prove the following:
1. If the drunk driver's blood alcohol is a .15% or greater;
2. The drunk driver REFUSES to take the test;
3. The knew or should have known their ability to operate a vehicle was impaired; and,
4. the drunk driver's intoxication caused the victim's injury or death. -
FACT: Punitive damages are limited in Virginia to no more than $350,000.00 (regardless of what amount the jury awards)
FACT: A drunk driver cannot discharge a drunk driving verdict in bankruptcy court. -
